IRS mandates E-filing for Form 990

On July 1, 2019, the IRS mandated electronic filing for all Form 990 series, as enacted as Taxpayer First Act. As a result, organizations can no longer submit paper returns for 990 forms and must file all 990 forms must be filed electronically.

The electronic filing requirements for all 990 forms are as follows:

  • Form 990-EZ: Must be electronically for tax years ending July 31, 2021, and later.
  • Form 990-PF: Must be e-filed for tax years ending July 31, 2020, and later.
  • Form 990: Must be filed electronically for tax years ending July 31, 2020, and later.
  • Form 990-T: Must be electronic filing for tax years beginning after July 1, 2019.

Paper filing for Form 990 is only allowed in rare circumstances, such as when an organization has received an IRS-approved waiver or qualifies under specific exception cases.

The specific exceptions that permit paper filing includes:

  • Short tax years: Most Forms 990, 990-EZ, and 990-PF for short years must be paper-filed.
  • Organizations with fewer than 250 total returns filed: Organizations that file fewer than 250 returns of any type (including employment tax, and information returns such as Forms 1099 and W-2) for the calendar year ending within their fiscal year may file paper Forms 990, 990-EZ, and 990-PF.
  • Certain religious organizations:
    • Churches, interchurch organizations of local units of a church, conventions or associations of churches, or integrated auxiliaries of a church
      • ( e.g., men's or women's organizations, religious schools, mission societies, youth groups)
    • Church-affiliated organizations exclusively engaged in managing funds or maintaining retirement programs as described in IRS Rev. Proc. 96-10.
    • Schools below college level affiliated with a church or operated by a religious order as per IRS regulations.
    • Mission societies sponsored by or affiliated with churches if more than half their activities are conducted in or directed at persons in foreign countries.
    • Exclusively religious activities of any religious order described in IRS Rev. Proc. 91-20.
  • Certain governmental organizations:
    • State institutions whose income is excluded under IRC section 115.
    • Governmental units or affiliates described in IRS Rev. Proc. 95-48.
    • Organizations described in section 501(c)(1), which are instrumentalities of the United States exempt from federal income tax.
  • Certain Political organizations:
    • State or local committees of political parties,
    • Political committees of state or local candidates,
    • Caucuses or associations of state or local officials,
    • Organizations required to report under the Federal Election Campaign Act of 1971 as political committees.
  • Organizations with gross receipts normally $50,000 or less:
    Organizations generally file Form 990-N electronically, but if they choose to file a full
    Form 990 or 990-EZ, they may be allowed to file on paper if they meet certain conditions.
  • IRS-approved waivers: Organizations that have obtained a specific waiver from the IRS due to inability or hardship in filing electronically may file paper returns.

Form 8868 (Application for Extension) can be filed either electronically or on paper. If an organization chooses to file by mail, the extension request should be sent to the appropriate IRS address.
